Trusted Memory Care ("we", "our", "us") understands the importance of protecting sensitive health information. When providing services to healthcare organizations and their partners, we recognize and respect the privacy and security requirements under the Health Insurance Portability and Accountability Act ("HIPAA") of 1996.

Business Associate Commitment

Trusted Memory Care may act as a Business Associate under HIPAA when providing services that involve protected health information (PHI) on behalf of a healthcare provider or covered entity. PHI includes any individually identifiable health information, whether in electronic, paper, or oral form, that relates to a person's medical condition, treatments, or payment for healthcare.

We commit to:

• Safeguarding PHI in accordance with HIPAA standards.
• Implementing administrative, physical, and technical safeguards designed to protect PHI against unauthorized use or disclosure.
• Signing Business Associate Agreements (BAAs) with all eligible healthcare clients and third-party service providers that handle PHI on behalf of healthcare organizations. (A BAA is required to ensure HIPAA-aligned protections are in place.)

Data Collection & Forms

Our website and associated services may collect information from visitors or clients. However:

• We do not intentionally collect PHI via our public contact forms.
• If you share health-related details through a form or message, please be aware that this may qualify as PHI under HIPAA.
• To prevent inadvertent disclosure, do not include sensitive medical information in general inquiry forms.
• Where applicable, we will ensure secure, HIPAA-aligned pathways for communication as part of a contracted engagement.

Use of Tools & Tracking

We only integrate analytics, advertising, communication, and CRM tools that meet HIPAA protections where PHI may be involved or where a BAA is required. If a marketing tool cannot provide a compliant environment or a signed BAA, we will:

• Not pass PHI to that service, or
• De-identify the data before use, as permitted under HIPAA rules.

Chat, email, contact forms, and other online communication tools on this website are for general informational and marketing purposes only. They are not secure channels for transmitting PHI or sensitive health information unless specifically configured and agreed upon in writing as part of a HIPAA-covered engagement.

Training & Internal Policies

Trusted Memory Care maintains internal policies, employee training, and security controls to protect the privacy and security of any PHI we are entrusted with while providing services under a Business Associate Agreement.
